Acceptable Use Policy - Clear Coat Systems

This Acceptable Use Policy (“AUP”) governs use of the Clear Coat Systems Detailing Software platform and services (the “Service”) and is incorporated into and forms part of the Clear Coat Systems Terms of Service / Master Subscription Agreement (the “Agreement”) between Clear Coat Systems LLC (“Clear Coat,” “we,” “us,” or “our”) and the customer (the “Customer,” “you,” or “your”). This AUP applies to the Customer and to all Authorized Users. Capitalized terms not defined here have the meanings given in the Agreement. We may update this AUP from time to time; the current version governs your use of the Service.

1. Your Responsibility

You are responsible for your own conduct, the conduct of your Authorized Users, and all activity occurring under your account, and for ensuring that your use of the Service complies with this AUP, the Agreement, and all applicable laws.

2. Prohibited Content

You may not upload, store, transmit, or otherwise make available through the Service any content that:

(a) is unlawful, fraudulent, defamatory, obscene, or otherwise objectionable;
(b) infringes or misappropriates any intellectual property, privacy, publicity, or other right of any person;
(c) contains viruses, malware, or other harmful code;
(d) is sexually explicit, or that exploits, harms, or sexualizes minors; or
(e) harasses, threatens, defames, or promotes violence or discrimination against any person or group.

3. Prohibited Activities

You may not:

(a) violate any applicable law, regulation, or third-party right;
(b) gain or attempt to gain unauthorized access to the Service, to other customers' accounts or data, or to any related systems or networks;
(c) interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure, including through denial-of-service attacks, automated overuse, or circumventing rate limits or security controls;
(d) reverse engineer, decompile, scrape, or systematically extract data from the Service except through features provided for that purpose;
(e) resell, sublicense, rent, or otherwise provide the Service to third parties except as expressly permitted in the Agreement;
(f) use the Service, or information obtained from it, to build or assist a competing product or service;
(g) misrepresent your identity, affiliation, or authority; or
(h) remove, obscure, or alter any proprietary notices in the Service.

4. Communications and Anti-Spam Compliance

The Service includes features that let you send communications (such as SMS/text messages, email, and push notifications) to your End Consumers. You are solely responsible for your communications and for compliance with all applicable laws, regulations, and carrier and industry requirements, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable CTIA and mobile-carrier guidelines. Without limiting the foregoing, you must:

(a) obtain and maintain all legally required consent before sending marketing or promotional messages;
(b) promptly honor opt-out, “STOP,” and unsubscribe requests;
(c) send messages only to recipients from whom you have the required consent or relationship;
(d) not send unlawful, deceptive, misleading, or unsolicited bulk communications;
(e) accurately identify yourself as the sender and provide required disclosures; and
(f) comply with applicable time-of-day and message-content restrictions.

You acknowledge that the Service may send SMS through a shared messaging number, and that opt-out handling for that number may apply across all businesses using the Service (a recipient who opts out is opted out of further messages sent through that number). You remain responsible for your own consent records and messaging practices.

5. End Consumer Data

When you collect, use, store, or transmit End Consumer information through the Service, you must:

(a) do so lawfully and only for legitimate business purposes;
(b) provide any privacy notices and obtain any consents required of you as the business interacting with the End Consumer;
(c) honor End Consumer privacy requests, opt-outs, and deletion requests as required by law; and
(d) not use End Consumer information in any manner that violates applicable law or the rights of the individual.

6. Security

You must safeguard your account credentials, use the Service's security features appropriately, avoid sharing credentials, and promptly notify us of any suspected security incident, vulnerability, or unauthorized access involving your account or the Service.

7. Enforcement

We may, but are not obligated to, monitor or investigate use of the Service and suspected violations of this AUP. We may remove or disable content, throttle, suspend, or terminate access (in whole or in part), with or without prior notice, where we reasonably believe a violation has occurred or to protect the Service, our customers, End Consumers, or third parties, or to comply with law. We may cooperate with law enforcement and respond to lawful requests. Suspension or termination for an AUP violation does not entitle you to any refund.
