This Acceptable Use Policy (“AUP”) governs use of the Clear Coat Systems Detailing Software platform and services (the “Service”) and is incorporated into and forms part of the Clear Coat Systems Terms of Service / Master Subscription Agreement (the “Agreement”) between Clear Coat Systems LLC (“Clear Coat,” “we,” “us,” or “our”) and the customer (the “Customer,” “you,” or “your”). This AUP applies to the Customer and to all Authorized Users. Capitalized terms not defined here have the meanings given in the Agreement. We may update this AUP from time to time; the current version governs your use of the Service.

You are responsible for your own conduct, the conduct of your Authorized Users, and all activity occurring under your account, and for ensuring that your use of the Service complies with this AUP, the Agreement, and all applicable laws.

The Service includes features that let you send communications (such as SMS/text messages, email, and push notifications) to your End Consumers. You are solely responsible for your communications and for compliance with all applicable laws, regulations, and carrier and industry requirements, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable CTIA and mobile-carrier guidelines. Without limiting the foregoing, you must:

You acknowledge that the Service may send SMS through a shared messaging number, and that opt-out handling for that number may apply across all businesses using the Service (a recipient who opts out is opted out of further messages sent through that number). You must safeguard your account credentials, use the Service's security features appropriately, avoid sharing credentials, and promptly notify us of any suspected security incident, vulnerability, or unauthorized access involving your account or the Service.

We may, but are not obligated to, monitor or investigate use of the Service and suspected violations of this AUP. We may remove or disable content, throttle, suspend, or terminate access (in whole or in part), with or without prior notice, where we reasonably believe a violation has occurred or to protect the Service, our customers, End Consumers, or third parties, or to comply with law. We may cooperate with law enforcement and respond to lawful requests. Suspension or termination for an AUP violation does not entitle you to any refund.
